Prop 215

Definition: Prop 215, the Compassionate Use Act of 1996, is the California ballot measure that made California the first US state to legalize medical cannabis. Voters approved it on November 5, 1996. It protects patients and their primary caregivers from state prosecution for possessing or growing cannabis for medical use with a physician’s recommendation.

What Did Prop 215 Allow?

Prop 215 added Section 11362.5 to California’s Health and Safety Code. It let seriously ill Californians use cannabis with a doctor’s written or oral recommendation, not a prescription, since doctors can’t prescribe a federally controlled substance. The law named conditions such as cancer, anorexia, AIDS, chronic pain, spasticity, glaucoma, arthritis, and migraine, plus “any other illness for which marijuana provides relief.” It also protected doctors from punishment for recommending cannabis.

Why Was Prop 215 Important?

It started the modern medical cannabis movement. Prop 215 showed that voters would back legal access, and dozens of states followed with medical programs over the next two decades. Because the law said little about how patients should obtain cannabis, it also led to California’s long era of patient collectives and cooperatives.

What Happened After Prop 215?

  • 2003: Senate Bill 420 created state medical ID cards and set possession guidelines.
  • 2016: Prop 64 legalized adult-use cannabis for everyone 21 and older.
  • 2017 to 2019: California merged medical and adult-use rules into one licensed system, and the old collective model was phased out.

Prop 215’s patient protections still stand today, and medical patients with a state ID card are exempt from California sales tax on medical cannabis.
